PMSL.com (the Company) has chosen to take up and use the policy that follows with regard to infringement of copyright in line with the Act that determines Digital Millennium Copyright (which can be found at: https://www.copyright.gov/legislation/dmca.pdf). The address for the Agent Designated to take Recept of any Notification of the Claimed Infringement (“Designated Agent”) can be found at the end of this policy document.

PMSL.com – DMCA COPYRIGHT POLICY

Reporting Copyright Infringement:

If you claim intellectual property of yours is in the process of being subject to violation, you have to submit to the Company:

  1. A signature, electronic or physical, of whoever is authorized to act on the copyright owner’s behalf in respect of the copyright which has allegedly been infringed;

  2. The identity of the materials or works being allegedly infringed;

  3. The identity of any material which is alleged to be doing the infringing. This is to include facts regarding the particular location of the materials that are allegedly doing the infringing on the website of PMSL.com, which the owner of the copyright is seeking to be taken down, with enough information to make it possible for PMSL.com to be able to discover and confirm its existence;

  4. The contact details for whoever is making PMSL.com aware, to include phone number, address, and, if possible, an e-mail address;

  5. A definite expression in writing that the person doing the notifying believes in good faith that neither the owner of the copyright nor an agent or the law has authorized the said material to be reproduced; as well as

  6. A definite expression in writing, which has been prepared with the knowledge that a false statement will be considered perjury, that the facts provided are correct in all details and whoever is making the notification has the authority to complain on the copyright owner’s behalf.

On Bona Fide Notification of Infringement being Received by the Agent who has been Designated:

It’s the policy of PMSL.com:

  1. to disable or remove access to that material that is being infringed;

  2. to let the provider of the content, user or member know that it has been removed or access to the subject matter has been disabled; and that

  3. any repeat offences of the material subject to infringement will be extracted from the system and that PMSL.com will end access to the service of the content provider in question or any member or user.

The Process to be followed for Supplying any Counter-Notice to the Agent who has been Designated:

  1. The content provider’s signature, or user, or member, physical or electronic;

  2. The identity of the removed material or that which has had access disabled plus wherever the material was prior to its removal or its access being disabled;

  3. A definite expression in writing that the provider of the content, user, or member believes in good faith that the material was taken off or put out of action due to error or the material’s wrongful identification; and

  4. Name, telephone number, address, and, if possible, e-mail address of the provider of the content, member or user, plus a definite expression in writing that said entity or person agrees to the Federal Court’s jurisdiction for the judicial district where the address of the content provider, member or user is to be found, or if the address of the provider of the content, member or user, is to be found outside the US, for whatever judicial district where PMSL.com is to be found, and that such entity or person will be happy to recive the process’s service from whoever provided the alleged infringement’s notification.

If the Designated Agent receives a counter-notice, it may be that PMSL.com sends a reproduction of the counter-notice to the party who made the original complaint letting that person know it could replace the material that has been removed or stop it being disabled within ten working days. At PMSL.com’s discretion, access to the removed material may be restored or the material replaced between ten and 14 working days or more following receipt of any counter-notice, that is unless the owner of the copyright files any action that seeks a court order against the content provider, member or user.
